His architectural practice has specialised in design development, project documentation, specification drafting, project coordination and statutory compliance issues, primarily for commercial, retail, hospitality and institutional building projects. He also offers specialist skills in contract and practice administration and forensic architectural consulting. John’s experience also includes interior and industrial design, commercial and business management.
A Practising Member of The Academy of Experts (TAE), John has acted as expert witness or adviser in construction and related disputes in Hong Kong, Australia and Asia. He has given expert evidence in court and arbitration, including written reports and oral testimony in person and virtually. As well as party appointments, John has appeared as a single joint expert in HK High Court proceedings. Matters in which he has been instructed mostly relate to building defects and professional practice, including design responsibility and compliance questions. He has also given opinion evidence on design and construction issues arising in non-construction cases, including personal injury, adverse possession, insurance claims and building management-occupier disputes.

The 8th Biennial Conference on Construction Projects from Conception to Completion, takes place 16 – 18 Mar 2023 at the Hotel de Rome, Berlin, Germany.
There is plenty of advice against amending standard forms. However, the reality is that parties cannot resist amendments, particularly as amendments may be required by funders or to address aspects of the applicable law. The panel will discuss the pros and cons of amendments to FIDIC conditions which they have seen agreed.
What should be included in the ideal variations clause, and what are the considerations when drafting? This session will review a draft clause for discussion by delegates.
What are the best ways of avoiding disputes which go to arbitration? The panellists will present and debate the procurement methods and contractual provisions which they consider to be the most effective.
It is often difficult to successfully pursue a claim for the costs of accelerating because an extension of time has not been granted that should have been. What are the challenges and how best are they overcome? The panel will provide a list of recommendations for discussion with delegates.
When a call on a demand guarantee (or ‘on demand bond’) is anticipated or in fact made, which jurisdictions are of interest to those trying to defend the call? The panellists will consider such jurisdictions and judgments issued by their courts. They will consider if there are preferred jurisdictions for those trying to defend calls against demand guarantees.
It is commonly accepted that party appointed experts in arbitrations should give independent and impartial evidence. The perception, if not also the reality, is that this often does not happen. What, if anything, can be done? The panel will present its recommendations for discussion with delegates.
Construction disputes often include many low value claims (eg, low value variations which are disputed in principle and/or quantum). Addressing them like other claims risks disproportionate costs. What are the options for addressing such claims (eg, sampling)? The panel will produce a menu of options and debate their advantages and disadvantages.
We each have a ‘friend’ who has worked on a big claim which was dismissed. What common lessons can be learned from discussing our friends’ unsuccessful cases? The panel will present a list for discussion with delegates, who are asked to bring tales of their friends’ unsuccessful cases to this session.

In June 2022 the King’s College London Centre of Construction Law will run, in cooperation with FIDIC, an intensive one-week course covering the FIDIC standard form contracts in practice. The FIDIC contract forms lie at the heart of many international projects, and this course will build on common law and civil principles in examining how FIDIC provisions and processes operate in various legal systems.
The course will be provided by leading practitioners and is designed to equip talented commercial managers, engineers and lawyers with advanced legal, commercial and practical knowledge in relation to FIDIC contracts and the legal background within which they operate. The FIDIC 1999 suite and the new FIDIC 2017 Red, Yellow and Silver books will be analysed in detail, with references to older FIDIC contracts such as the 1987 Red Book and 1995 Orange Book when focusing on experience drawn from particular projects.

A FIDIC Certified Adjudicator is someone with expert knowledge of the FIDIC Standard Forms of Contract with experience, knowledge and ability to act impartially and independently as an Adjudicator on Dispute Boards under these forms and/or any contracts based on them.

It is a real honour and privilege to have qualified to take the assessment let alone pass, I qualified as a barrister and the demanding examination process by FIDIC that tested contractual knowledge across the entire FIDIC suite, demanding oral and written assessments and knowledge of civil and common law jurisprudence really was much harder by way of comparison. As a serving adjudicator and dispute board member this qualification will help distinguish me in the market and give clients the confidence to select me as a Dispute Board Member.
One of FIDIC’s new ‘FIDIC Golden Principles’, which enshrine FIDIC’s core contracting philosophy, provides that “All formal disputes must be referred to a Dispute Avoidance / Adjudication Board (“DAAB”) for a provisionally binding decision as a condition precedent to arbitration.” Parties are therefore discouraged from amending a FIDIC form to state otherwise. As signalled by the name change, the new DAAB differs considerably to the Dispute Adjudication Board (“DAB”) of the 1999 Suite.
– The default position is that all DAABs are ‘standing’, i.e. appointed at the outset of the Contract and throughout its lifetime;
– The Parties may jointly request DAAB assistance in relation to any issue, and the DAAB may also invite the Parties to make such a request;
– The 2017 Suite expressly provides that upon termination of the Contract, the DAAB will expire 28 days after the DAAB has given its decisions on all Disputes referred to it or (if earlier) when the Parties reach final agreement on all matters in connection with the termination;
– A Party may provide a Notice of Dissatisfaction (“NOD”) in relation to part only of a DAAB Decision; that part is then deemed severable from the rest of the DAAB decision and the remainder becomes final and binding to the extent that no NOD is given in respect of it;
– Even if a NOD has been issued, if a Party fails to comply with a DAAB Decision, the winning party under the Decision may refer the losing party’s failure to comply with the DAAB decision directly to arbitration (i.e. without a separate DAAB Decision and amicable settlement period).
